General Terms and Conditions

This is a non-binding translation for information purposes only. The German version is legally authoritative, including in the event of any discrepancies. References to Austrian statutes (FAGG, ECG, DSGVO/GDPR) refer to the applicable Austrian and EU law.
§ 1 Scope
These General Terms and Conditions ("Terms") apply to all contracts between musicmaker.studio (the "Provider") and natural or legal persons (the "Customer") entered into via the musicmaker.studio website or in person. This includes community subscriptions (support contributions), the purchase of workshop and event spots, and other services provided by the Provider. Deviating terms of the Customer are not recognized unless the Provider expressly agrees to them in writing.
§ 2 Conclusion of contract
Subscriptions: A subscription contract is concluded upon completion of the payment process via the respective Stripe payment link. By completing payment, the member accepts these Terms. A confirmation is sent by email by the payment provider Stripe.
Workshop and event spots (paid): The contract for participation is concluded upon successful completion of the Stripe payment process. Payment secures the Customer a spot on the guest list of the respective event or workshop.
Free events with registration: Registration by email constitutes a non-binding reservation. No contract is concluded; the reservation may be canceled by the Provider at any time if capacity is exceeded or for other reasons.
§ 3 Community subscriptions
musicmaker.studio offers the following monthly subscription tiers. The current prices and service descriptions are published on the website.
- Friend – €5/month
Newsletter and one annual invitation to the community meeting. - Community Supporter – €10/month
Invitation to quarterly meetups (including jamming and community events), access to the WhatsApp group, and all benefits of the Friend tier. - Workshop Supporter – €30/month
Free access to all workshops during the active support period, a musicmaker.studio T-shirt, and all benefits of the Community Supporter tier. With an uninterrupted support duration of 6 months or more, free workshop access is extended by a further 6 months after the subscription ends. - Music Supporter – €60/month
A private living-room concert by a selected act from the community, a musicmaker.studio T-shirt, and all benefits of the Workshop Supporter tier. The concert is organized once the member has been an uninterrupted Music Supporter for 5 months. - Festival Supporter – €100/month
4 VIP tickets per musicmaker.festival for the entire active support period, a musicmaker.studio T-shirt, and all benefits of the Music Supporter tier. With an uninterrupted support duration of 6 months or more, the VIP ticket entitlement is extended by a further 12 months after the subscription ends. Months of support rendered before the first festival takes place count toward the bonus period.
§ 4 Workshops and events
The Provider organizes workshops and events, which may be paid or free of charge. Information on date, time, location, price and participation requirements is published on the website.
Guest list: For paid events, successful payment reserves a spot on the guest list. The Provider may confirm the guest list on request by email. No ticket or separate admission document is issued; the Stripe payment confirmation serves as proof of entitlement.
Capacity: The number of spots is limited. Entitlement to participate exists only if capacity is available at the time of purchase. If an event is fully booked, the purchase process is blocked by the system.
Obligation to attend: By purchasing a spot, the Customer is obligated to attend the event or cancel the spot in good time (§ 7). Failure to attend without excuse does not give rise to a right to a refund.
§ 5 Payment
Subscriptions: Billing occurs monthly in advance. The first payment is collected immediately upon completion of the subscription. All subsequent payments are collected automatically on the same date of each following month.
Workshop and event spots: Payment is made once, in advance, and is due immediately. The spot is only considered secured once payment has been received in full.
All payments are processed via the payment provider Stripe. The terms of use of Stripe (stripe.com/legal) additionally apply. All stated prices include statutory VAT where applicable.
§ 6 Cancellation of subscriptions
All subscriptions may be canceled monthly. Cancellation can be submitted at any time via the cancellation form on the website. It takes effect at the end of the current billing period. The member receives a confirmation by email.
If the member is unable to submit a cancellation via the form (e.g. because the email address on file is no longer accessible), cancellation may be requested in writing by email to elias@musikschafferei.at. The cancellation will then be processed manually and will likewise take effect at the end of the current billing period.
Benefits tied to a minimum support duration (living-room concert, extended workshop access, festival bonus) are forfeited upon early cancellation if the respective minimum duration has not yet been reached.
§ 7 Cancellation and postponement of workshops/events
Cancellation by the Customer: A purchased spot may be canceled up to 7 days before the event date by email to elias@musikschafferei.at. In this case, the amount paid will be refunded less a processing fee of €2. For cancellations within 7 days of the event, there is no entitlement to a refund. However, the spot may be transferred to another person with the Provider's consent.
Cancellation by the Provider: If an event must be canceled or postponed by the Provider (e.g. due to illness, force majeure, or insufficient participant numbers), all amounts already paid will be refunded in full. Further claims (e.g. travel costs) are excluded.
Free events: For free events with registration, we kindly ask that cancellations be sent by email at least 48 hours before the event begins, so that the spot can be given to someone else.
§ 8 Right of withdrawal
Subscriptions: Consumers have a 14-day right of withdrawal pursuant to § 11 FAGG (Austrian Consumer Right of Withdrawal Act). The period begins upon conclusion of the contract. Withdrawal must be declared in writing by email to elias@musikschafferei.at. If performance has already begun, a pro-rata fee may be charged for services already rendered.
Workshop and event spots: Pursuant to § 18 para. 1 no. 12 FAGG, there is no right of withdrawal for contracts for leisure services performed on a specific date. As workshops and events take place on a specific date, the right of withdrawal is excluded. The cancellation terms under § 7 of these Terms apply.
§ 9 Performance and availability
The Provider strives to deliver all promised services (events, workshops, concerts, festival tickets) to the extent described. Dates for workshops and community meetings are communicated in good time via the WhatsApp group and the newsletter.
The living-room concert (Music Supporter) is organized in coordination with the member once the requirement is met. The choice of act is at the Provider's discretion; the member's musical preferences are accommodated where possible.
Festival VIP tickets (Festival Supporter) are only issued if the musicmaker.festival actually takes place. Should a festival not be able to be held, there is no entitlement to a substitute service for the canceled event; the subscription contract remains unaffected.
§ 10 T-shirt
The musicmaker.studio T-shirt is sent once, after completion of an eligible subscription (Workshop Supporter, Music Supporter, Festival Supporter), by post or handed over in person. Size and availability are coordinated in advance. There is no entitlement to an additional T-shirt when changing tiers.
§ 11 Price changes
The Provider reserves the right to adjust prices with 30 days' notice. Existing members will be informed by email. In the event of a price increase, the member has the right to cancel the subscription effective at the end of the current billing period.
§ 12 Liability
The Provider is not liable for damages caused by force majeure, regulatory orders, or other unforeseeable events (e.g. cancellation of an event or workshop). Liability for slight negligence is excluded to the extent permitted by law.
Participation in workshops and events is at the participant's own risk. The Provider assumes no liability for instruments, equipment, or personal belongings brought by participants.
§ 13 Data protection
Personal data is processed in accordance with the Provider's Privacy Policy and the provisions of the GDPR. Payment data is processed exclusively by Stripe and is not stored by the Provider.
§ 14 Governing law and jurisdiction
Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). Jurisdiction is Linz, Austria. For consumers, the statutory place of jurisdiction applies. For out-of-court dispute resolution, the Austrian Consumer Arbitration Board (RSP) may be contacted.
§ 15 Severability
Should individual provisions of these Terms be or become invalid, the validity of the remaining provisions remains unaffected. The invalid provision will be replaced by a legally permissible arrangement that comes closest to the economic purpose of the original provision.
These Terms are a draft and have not been reviewed by a lawyer. Legal review is recommended before productive use.
